According to Re-Tox, a judge has dismissed Glenn Danzig's lawsuit against current Misfits leader Jerry Only over his use of, and business dealings relative to, the Misfits logo and trademark. In his April 2014 lawsuit, Danzig alleged that Only violated a 1994 contract between the two and also claimed that Only's misappropriation of the trademarks caused him more than $75,000 in damages. Clearly, a U.S. district judge in California disagreed. Re-Tox says that last week the judge dismissed the lawsuit because Danzig "failed to state a claim upon which relief may be granted" and also "failed to allege which terms of the 1994 agreement Only actually breached." As it stands, Danzig will receive no compensation whatsoever from Only.
